Closing With a Title Company in Southwest Florida

30 years serving Southwest Florida since 1996

Title companies are a familiar closing choice for Southwest Florida buyers and sellers. Here is what they handle.

A clear path to closing

What your title company coordinates

The closing company brings together the documents, funds and title requirements needed to complete the transaction. Its work commonly includes coordinating the title search, reviewing requirements for issuing title insurance, obtaining payoff information, preparing settlement figures, arranging signing and disbursing funds.

The company coordinates with the buyer, seller, real estate agents and lender. Ask early about the closing schedule, information needed from you, signing arrangements and how final payment instructions will be provided.

Title search and title insurance

The title search examines recorded ownership and matters affecting title, such as liens or easements. Requirements may need to be satisfied before the title insurer will issue a policy. Review exceptions and unresolved items with the closing company rather than assuming every recorded matter disappears at closing.

An owner’s title insurance policy and a lender’s policy serve different interests. The lender’s policy protects the lender’s covered interest; an owner’s policy protects the owner subject to its terms and exclusions. Ask which policies are included and who pays each charge under your contract.

Title company and attorney: the practical distinction

A licensed title agency handles title insurance and settlement services. An attorney can provide legal advice and representation within an agreed engagement and may also operate a title agency. The business name alone does not establish whether anyone is representing you legally.

For a routine transaction, focus on a capable closing company, clear communication and timely completion of requirements. If a specific legal dispute or unusual ownership issue arises, that issue may require separate legal advice. A title company’s settlement role does not itself create an attorney-client relationship.

Choosing the closing company

  • Confirm the company’s identity, licensing and contact details.
  • Review the contract provisions governing selection and payment of title charges.
  • Ask for an itemized estimate, including insurance and settlement services.
  • Confirm how deposits, payoffs and final funds will be handled.
  • Discuss remote signing or travel needs well before the closing date.

Who pays and what happens after signing?

Payment of title premiums and closing charges depends on the negotiated contract and applicable requirements; local custom should not replace checking the agreement. After signing, completion also depends on funding and the closing company’s requirements. Confirm when keys and possession will be released and how you will receive recorded documents and the title policy.
